Risk Assessment Changes

The HSE are looking at carrying out Risk Assessment Changes.  They are concerned that many people see the requirement to record significant findings of a risk assessment as something separate from other things they do to manage their business.

Risk assessments should be about identifying sensible measures to control the risks in your workplace.  More emphasis on controlling risk and less on written assessments but without reducing standards.

Summary of recent HSE Legislation Enforcement

A building company was fined £144,000 with costs of £43,606.15 when a worker fell 5 metres from the roof of a house in London.  The fall resulted in a 3 month hospital stay from injuries including a fractured spine and an induced coma for 2 weeks.  Works were carried out unsupervised and an enforcement notice was served after finding removed broken asbestos in a pile with other debris by the neighbour’s hedge.

A scaffolding business owner was sentenced to 4 months in prison suspended for 2 years. His partner (son) was sentenced to an 8 month prison sentence suspended for 2 years with costs of £25,661.  An employee fell 7 metres to his death after dismantling scaffolding.  He was stacking roofing sheets on a flat roof without edge protection and safety railing was removed so that sheets could be stacked.   There was no PPE worn, e.g. harnesses.  The condition of the scaffolding failed to meet current safety standards.

A Recycling company have been fined £300,000 with £8,903 in costs after failing to enforce the ‘safe stop’ process which should be followed when using dangerous machinery.

Star Wars

Finally, Star Wars film maker was fined £1.6 million with £20,861.22 costs for injuring Harrison Ford. He was knocked off his feet and pinned to the floor of the Millennium Falcon set as prop door closed on him.  The HSE found there was no automatic emergency cut off instead of relying on the reaction of the prop operator to bring the door to a stop.  The power and speed of the door was such that, had Mr Ford or anyone else struck on the head by the door as it closed, they might easily have been killed.

Glazed fire doors offer a number of benefits in everyday working life as well as in case of an emergency. Furthermore Pyroguard fire safety glass allows for the natural flow of light through and around a building, therfore creating a pleasant atmosphere for those working inside. Fire Doors

Fire doors are a type of door that are used to contain a fire in a particular part of your building, they help to protect people in any commercial property from any smoke or fire, such as, Schools, Care homes, Offices, Hotels and Restaurants.

Different fire doors have different hourly ratings depending on what material they are made with. Consequently they can be timber or steel which means the length of time the fire door can stand up to a fire.

Fire doors can often be plain or paneled, they can also be glazed. Fire resistant glass is needed if this is the case.

Waller Glazing Services stocks two types of clear fire glass, the first being  7.2mm Pyroguard which holds a fire rating of 30 minutes. The second is 7mm Pyroguard this offers a 60 minute fire rating. We are the sole stockists of this glass in the South East.

New Apprenticeship Levy Scheme

This is a brief summary of how things are changing:

The new Apprenticeship levy scheme:

If PAYE turnover is over £3m then a 0.5% levy has to be paid in (with an initial tax allowance of £15k).  this equates to no levy being paid on the first £3m of PAYE turnover

If PAYE turnover is less than £3m then no levy will be paid.  However, any training will have to be paid for and subsidised by the government at a rate of 2:1 (ie. An electrician’s course will be £27k; £9k paid by the Company with £18k subsidised by the government)

 

Some of the new rules:

  • The levy will have to be paid on a monthly basis into an account.  If that fund is not claimed within 18 months then it will be lost and cannot be claimed back
  • A Company can only claim back the amount they have paid in, no more.  If they do any more training after their pot is empty then they will only get an additional 10% subsidy against it.  Bearing in mind there is a £15k tax allowance, a Company with £5m PAYE turnover would have paid in £10k but have a pot of £25k
  • The funds can ONLY be used for apprenticeship training
  • This levy is going to be in addition to the CITB levy!
  • To claim the funding, it will be split (For example with 16-18 year olds):

Recruit: £5,400

If a small business then an additional £2,700 can be claimed

If the apprentice completes and passes their course an additional £2,700 can be claimed

TOTAL: £10,800 per apprentice

NOTE: The apprentice has to pass by the 2nd attempt or the completion amount will not be paid

 

There are definite advantages of being below the £3m PAYE threshold:

  1. There is no additional levy to pay
  2. You can claim more per apprentice (£18k compared to £10,800)
  3. There is no limit to the number of apprentices as you have not got a pot that can dry up

 

As this is due to come in next year.  The advice I would give is take on an apprentice this year especially if they are 16-18 as they will still be free.

Health & Safety

Due to a breach of health & safety regulations, a building company were fined £40,000 with £3,000 costs under the Health and Safety at Work Act etc 1974 and Regulation 22(1)a of the CDM Regs 2007. Building materials fell through the site hoarding onto the pavement and highway.

Working At Height

Furthermore a roofing company was fined £18,000 with £4,089 costs after a worker fell through a roof light 3 metres to the ground and suffered injuries to his head, wrist and hip. Another company was fined £10,000 with £1,355 costs after a worker slipped and fell 7 metres through a roof sheet when replacing roof lights.  In this case no risk assessment had taken place or precautions taken to prevent falls from the edge of the roof or various fragile elements.

Hand-Arm Vibration

2 construction firms have been fined £12,000 with £8,246 costs. The other £280,000 with costs of £8,246 under the Health and Safety at Work etc. Act 1974 for failing to adequately manage risk where workers were regularly exposed to hand arm vibration through the use of range of vibratory tools.

HSE Update

There has been an HSE update enforcement action relating to working on fragile roofs, working at height and accidents with plant and vehicles.

This included a window fitting company (GFT Frames Ltd). They were fined £6,000 plus £9,953 in costs and the principal contractor at a construction site being fined £20,000 with £9,953 in costs under the CDM Regs 2007.  This was for safety failings after a worker fell a total of 3 metres whilst installing glazed units in a block of flats under construction.

The employee had been carrying window frames through the stairwell of the block of flats under construction. There were no stairs in place, just a ledge which was part of the structure that would act as a landing half way up the stairs once they were installed. After completing the unloading all the frames, the employee and colleague were accessing the first floor, up through the void.   As Mr Sheppard climbed onto the first floor from the ledge, he slipped, falling approximately 1.7 metres back to the landing and then a further 1.3 metres to the ground floor. He sustained two fractured ribs and a broken thumb.

The HSE investigation found GFT had failed to properly plan, supervise or carry out the work at height in a safe manner under the Work at Height Regulations 2005.  Furthermore the principal contractor had failed to plan manage and monitor the construction phase and failed to provide workers with a site induction.
